The state is preparing to move an appeal before the Supreme Court challenging an HC order that granted ad-interim bail to Mahfuzur Rahman Sharod, the main accused in a case filed for raping and blackmailing a student of Rajshahi University in January last year.
The HC bench of Justice Md Rezaul Haque and Justice Md Atoar Rahman granted the bail on March 25 after hearing an appeal filed by the accused seeking bail.
Deputy Attorney General Saifuddin Khaled told our staff correspondent yesterday that the state is preparing to move an appeal before the apex court challenging the HC order.
Mahfuzur Rahman will be released from Rajshahi jail if the Appellate Division does not stay the HC order of his bail, his lawyer ABM Altaf Hossain told The Daily Star yesterday.
He said the HC granted bail to Mahfuzur Rahman on the grounds that it was mentioned in the medical report that there is no sign of sexual intercourse and all other accused in the same case, including two who made confessional statements to the magistrate concerned, have already been granted bail by the HC.
Only the rape charge has been mentioned in the charge sheet against accused Mahfuzur Rahman, although there is no sign of sexual intercourse according to the medical report, he said, adding that Mahfuzur has been suffering in jail for 14 months.
